• In what areas do you represent disability claimants? Am I disabled?
Social Security defines disability as an inability to engage in substantial gainful activity for a continuous period of 12 months as the result of a medically determinable physical or mental impairment. Call me or submit your claim online for a free evaluation.
Why do I need an attorney?
Your chance of success is higher if I represent you.
If you have ever taken a trip to an unfamiliar destination, you know that you must have directions to get to where you want to go. That is true of the Social Security disability process as well. I can guide you to a successful resolution of your claim.
Why should I hire you instead of someone else?
You should hire me ONLY if you feel confident in my ability to represent you. The only way you can decide whether you do is to talk to me. I will answer your questions.
My training, education, prior experience as a staff attorney for the Social Security Administration and focus on Social Security Disability in my practice mean that you will have an experienced advocate on your side.
I give my cases and clients individual and personalized attention. I will personally consult with you in a telephone conference. I will personally meet with you in my office for an initial conference. We will have a conference before you have a hearing before an Administrative Law Judge, face to face if possible, or on the phone if you live too far away to meet in person. That conference will last from 1 to 2 hours, to make sure that you are well prepared for your hearing, and to maximize my effectiveness as your attorney in the hearing. There are many attorneys and representatives who do not even MEET their clients until the day of the hearing.
I will help to secure medical records from treating physicians, assist you in responding to questionnaires that you are required to complete, assess the issues in your case and help you to focus on the information that will most effectively assist an Administrative Law Judge to approve your claim. I will prepare you to testify in your hearing, and frequently prepare a brief addressing the legal and medical issues in your case, present an opening statement and closing argument at your hearing and conduct cross examination of medical and vocational expert witnesses that may appear at your hearing.
How can you represent me in my disability claim if I live in a different city or state?
Social Security disability law is Federal, and applies uniformly in all 50 states. I am authorized to represent you in your claim regardless of the city or state where you live.
I can represent a client who lives in another state by using the telephone, fax, mail and email for all work required on the case except for the hearing. While in such a circumstance we may not have an opportunity to meet face to face until the day of the hearing, we will have discussed your case literally for hours on the telephone prior to such time. I do not charge for my travel expenses or travel time to your hearing, so my representation costs no more than that of an attorney located in your home town.
Will my claim be approved at the initial application?
Close to 2/3 of claims are denied on the initial application. Call me to discuss your claim or submit it online for a free evaluation.
When should I contact an attorney?
Now. Don't wait until your claim has been denied. There may be steps that can be taken earlier in the application process that will improve your chance of success. Hiring an attorney is one of those steps. I recommend that individuals confer with me and hire me prior to filing their initial application for disability benefits.
What if I've already lost a hearing?
Contact me. There may be steps that you can take immediately to improve your future chances of success with your disability claim.
What information will you need from me?
Most of the information required to determine whether or not you have a viable claim for disability benefits can be obtained in a telephone conversation or submitted online. If you decide to hire me, I will work with you in obtaining medical records, physician's statements, relevant employment information and, of course, extensive information from you regarding your limitations and abilities.
What do you charge?
There is no fee unless you win your claim. You pay no out of pocket money up front. The amount of the attorney's fee cannot exceed 25% of back pay or $5300, whichever is less. The amount of the fee is set and approved by the Social Security Administration in each case.
